Terms of Use

Welcome to NearFar. These Terms of Use (the "Terms") apply when you access or use the NearFar website, application, model chat, model comparison, content organization, sharing, subscription, credits and related services (collectively, the "Services") provided by HONG KONG INSTANT CREATE Limited (香港即創科技有限公司) ("we", "us" or "our"). By using the Services, you confirm that you have read, understood and agreed to these Terms.

1. Service Description

NearFar is a multi-model AI chat and comparison tool. You may select one or more models, submit questions, text, images or other content, and view answers, differences and summaries generated by different models. Some model, login, payment, storage, analytics or infrastructure capabilities may be provided by third-party services.

We may continue to adjust the Services, including adding, changing, limiting or discontinuing certain models, features, quotas, plans or page displays. We try to keep the Services stable, but we do not guarantee that any model, feature or third-party service will always be available.

2. Account and Access

You may need to sign in to use the full functionality. You should keep your registration, login and payment information true and accurate, and protect your account credentials. You are responsible for activity under your account unless the activity was not caused by your fault.

If you use NearFar on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf. We may suspend, limit or terminate account access for security, compliance, abuse prevention or product reasons.

3. User Content and Output

Prompts, text, images, attachments, feedback, conversation titles and other materials you submit to NearFar are called "Input". Answers, summaries, comparison conclusions and other content returned by models based on Input are called "Output". Input and Output are collectively called "User Content".

As between you and us, you retain rights to your Input. To the extent permitted by law, you may use Output. However, AI output may not be unique, and other users may receive similar or identical output. You are responsible for confirming that you have the right to submit Input and that User Content does not infringe others' rights, violate applicable law or breach these Terms.

To provide, maintain, protect and improve the Services, we may process User Content, including sending necessary content to the model providers you select or that the system routes to, in order to generate answers, troubleshoot issues, perform safety reviews, handle abuse, provide history and support sharing features.

4. Accuracy of AI Output and Your Responsibility

AI output may be inaccurate, incomplete, outdated, biased or unsuitable for your specific situation. NearFar does not provide legal, medical, financial, investment, tax or other professional advice. You should not treat Output as the sole source of truth or use it for decisions that may have significant impact on individuals or organizations without human review.

Before copying, publishing, sharing, commercially using or relying on Output, you should review its accuracy, legality, appropriateness and usefulness.

5. Third-Party Models and Services

NearFar may integrate third-party models or services such as OpenAI, Anthropic, Google, DeepSeek, Moonshot, Alibaba Cloud, Volcano Engine, Zhipu, MiniMax, xAI, Meta and Mistral. Third-party models and services may have their own terms of use, privacy policies, content policies, rate limits, regional restrictions, retention periods and security rules.

You understand and agree that, to generate answers, relevant Input, context, model selections and necessary conversation metadata may be sent to the corresponding third-party models or services. Availability, output quality, latency, limitations or policy changes of third-party services are not fully controlled by NearFar.

6. Prohibited Conduct

You must not use NearFar to:

  • violate applicable laws or regulations, infringe others' rights, or evade third-party model policies;
  • submit, generate or distribute unlawful, infringing, fraudulent, malicious, harassing, hateful, sexual, violent or other high-risk content;
  • collect, process or disclose personal information, trade secrets, credentials, keys or sensitive data without authorization;
  • bypass quotas, rate limits, payments, access controls, safety measures or model restrictions;
  • scrape, bulk call, reverse engineer, attack, interfere with or disrupt NearFar, model providers or related systems;
  • falsely claim that AI output was entirely generated by a human, or use it to mislead, impersonate or deceive others;
  • use NearFar to develop models, services or datasets that substantially compete with NearFar or its underlying models, unless expressly permitted.

7. Subscriptions, Credits and Fees

NearFar may offer free quotas, subscription plans, basic credits, advanced credits or other billing methods. Benefits are subject to the page display, order confirmation or backend configuration. Credits generally may only be used for NearFar Services, have no cash value, are non-transferable, and are non-refundable unless required by law or otherwise stated by us.

If you purchase a subscription or credits, you should provide accurate payment information and authorize us or our payment service provider to charge according to the agreed terms. Prices, quotas, model consumption and plan benefits may change. For material price changes affecting existing subscribers, we will try to notify you in advance.

8. Intellectual Property

The NearFar website, interface, brand, logo, code, design, copy, data structure, model configuration, ranking logic and service organization are owned by us or our licensors. Without permission, you may not copy, modify, distribute, sell, reverse engineer or otherwise misuse NearFar's protected content.

9. Service Changes, Suspension and Termination

We may change, suspend or terminate the Services for product iteration, compliance requirements, cost control, third-party restrictions, security risks or abuse prevention. You may stop using NearFar at any time. If you violate these Terms or create risk, we may limit, suspend or terminate your account or access to related content.

10. Disclaimers and Limitation of Liability

To the extent permitted by law, NearFar provides the Services on an "as is" and "as available" basis. We do not guarantee that the Services will be uninterrupted, error-free, fully secure, permanently stored, meet all of your needs, or that any Output will be accurate, reliable or fit for a particular purpose.

To the extent permitted by law, we are not liable for indirect, incidental, special, punitive or consequential losses, including loss of profits, goodwill, data, business opportunities or losses caused by model output errors. If the law requires us to be liable, our liability will be limited to the amount you actually paid for the relevant Services in the 12 months before the dispute arose; if you paid no fees, liability will be limited to the minimum extent permitted by law.

11. Governing Law and Dispute Resolution

The governing law, competent courts or arbitration forum for these Terms will be supplemented after the dispute resolution arrangement is further confirmed. Until then, any dispute should first be resolved through friendly consultation. If consultation fails, the dispute will be handled according to applicable mandatory laws.
